Terms of service

Last updated Nov 2, 2026

Terms of Service

These Terms of Service govern an institution's access to and use of Lecon, the curriculum management service available at lecon.app.

Where an institution has signed an order, agreement, subscription contract, or other written arrangement with us, that document and these Terms are read together. If they conflict, the signed document takes precedence to the extent of the conflict.

1. Who You Are Agreeing With

Lecon is operated by LECON EDUCATION TECHNOLOGY INC., a company incorporated in British Columbia, Canada.

"We", "us", and "our" refer to that company. "You" and "your" refer to the educational institution that subscribes to Lecon.

"Authorized Users" means the individuals whom your institution permits to access Lecon, including administrators, faculty members, staff, and other approved users.

By subscribing to or using Lecon, you confirm that you have the authority to accept these Terms on behalf of your institution.

2. The Service

Lecon is a curriculum and academic management platform that helps educational institutions organize, manage, review, approve, and publish academic information.

The service may include tools for managing programs, courses, learning outcomes, syllabi, curriculum maps, approval workflows, rubrics, accreditation evidence, institutional records, and related academic documentation.

Each institution operates within its own designated workspace and address, such as yourcollege.lecon.app. Institutional records are maintained separately from those of other institutions.

We may introduce new features, improve existing functionality, or make changes to the service from time to time.

If a change materially reduces an existing feature or functionality that your institution relies on, we will provide reasonable advance notice to your institution's administrators by email.

We do not guarantee that every feature will remain available indefinitely, but we will make reasonable efforts to avoid material disruption to the service.

3. Accounts and Authorized Users

Your institution's administrators are responsible for managing user accounts, assigning roles, and determining the level of access each user may have.

You agree to:

  • Ensure that only authorized individuals are given access to your institution's workspace.

  • Maintain accurate user account information.

  • Keep login credentials secure and confidential.

  • Remove or update access when a user's role or employment status changes.

  • Notify us promptly if you become aware of unauthorized access or suspected account compromise.

Accounts are assigned to individuals, not positions or departments. Sharing one account among multiple people is not permitted because it compromises the accuracy of activity logs and institutional records.

Your institution is responsible for the activities of its Authorized Users and for ensuring that they comply with these Terms.

We may suspend an account where we reasonably believe it has been compromised, misused, or used in violation of these Terms.

4. Acceptable Use

You agree to use Lecon only for lawful institutional and educational purposes.

You must not:

  • Use Lecon to violate applicable laws or regulations.

  • Upload or store content that you do not have the legal right or permission to use.

  • Attempt to access another institution's workspace, records, or information.

  • Circumvent security measures or interfere with the separation of institutional data.

  • Probe, scan, test, or load-test the service without our prior written permission.

  • Interfere with the operation, security, or availability of Lecon.

  • Reverse engineer, decompile, or attempt to extract the source code of the service, except where applicable law expressly permits it.

  • Copy, reproduce, resell, sublicense, or commercially exploit the service without our written permission.

  • Use the service to distribute malicious software or conduct unauthorized activities.

You may provide access to individuals outside your institution only where the service supports that access or we have otherwise agreed to it in writing.

We reserve the right to investigate suspected violations and take reasonable steps to protect the service and its users.

5. Your Content and Data Ownership

Your institution retains ownership of all content and data it uploads, creates, or maintains through Lecon.

This includes, but is not limited to:

  • Program and course information.

  • Curriculum structures and curriculum maps.

  • Course outlines and syllabi.

  • Learning outcomes and assessment materials.

  • Rubrics and academic documentation.

  • Accreditation and quality assurance records.

  • Institutional documents and uploaded files.

  • Institution-specific approval records and related information.

You grant us a limited, non-exclusive right to host, store, process, transmit, and display your content solely as necessary to provide, maintain, secure, and support Lecon in accordance with these Terms and our Privacy Policy.

We do not:

  • Sell your institutional content or data.

  • Use your institutional content to train artificial intelligence or machine learning models.

  • Use your institutional content for advertising or marketing to third parties.

  • Access your content for purposes unrelated to operating and supporting the service, except where required by law or authorized by your institution.

We may collect and use technical, diagnostic, and usage information to maintain, secure, troubleshoot, and improve Lecon, provided that such activities do not disclose your confidential institutional content or improperly identify individual users.

You may export your institutional records using the available export functions. Additional information about data access and deletion is provided in Section 15 and our Privacy Policy.

6. Data Protection and Security

We recognize that educational institutions may store confidential institutional information and personal information through Lecon.

We will maintain reasonable administrative, technical, and organizational safeguards designed to protect institutional data against unauthorized access, disclosure, alteration, loss, or destruction.

We will:

  • Process institutional data only as necessary to provide, maintain, secure, and support Lecon, or as otherwise authorized or required by law.

  • Restrict access to institutional data to personnel and service providers who need access to perform their responsibilities.

  • Require appropriate confidentiality and data protection obligations from personnel and service providers who may access institutional data.

  • Use reasonable security measures to protect the service and institutional records.

  • Maintain backup procedures designed to support recovery in the event of data loss or service disruption.

If we become aware of a security incident involving unauthorized access to or disclosure of institutional data, we will notify the affected institution without undue delay and provide reasonable assistance with investigating and addressing the incident.

We may use third-party hosting providers and other service providers to operate Lecon. We will take reasonable steps to ensure that such providers are subject to appropriate confidentiality and data protection obligations.

Your institution is responsible for ensuring that it has the necessary authority, permissions, and legal basis to upload and process personal information through Lecon.

Where required by the nature of the services or applicable law, we may enter into a separate Data Processing Agreement (DPA) with your institution. If a signed DPA conflicts with this section, the DPA takes precedence regarding the processing of personal information.

Further information about our data handling practices is provided in our Privacy Policy.

7. Our Intellectual Property

Lecon and its underlying technology remain the property of LECON EDUCATION TECHNOLOGY INC. or its respective licensors.

This includes:

  • The Lecon software and platform.

  • Source code and underlying architecture.

  • User interface and visual design.

  • Platform features and functionality.

  • Software documentation and technical materials.

  • Proprietary templates, tools, and system components.

  • Lecon's name, logo, branding, and related materials.

Your institution receives a limited, non-exclusive, non-transferable right to access and use Lecon during its active subscription period, subject to these Terms.

Nothing in these Terms transfers ownership of Lecon's intellectual property to your institution.

Your institution retains ownership of its own curriculum content, documents, academic materials, and institutional records, as described in Section 5.

8. Connections to Other Systems

Lecon may integrate with third-party systems, including learning management systems (LMS), identity providers, student information systems (SIS), and other institutional applications.

By enabling an integration, you authorize us to exchange information with the relevant system to provide the requested functionality.

Your institution is responsible for:

  • Maintaining the necessary permissions and authorization for connected systems.

  • Providing accurate integration credentials and configuration information.

  • Ensuring that it has the necessary rights to exchange information with those systems.

  • Complying with the applicable terms and policies of third-party providers.

Third-party systems are operated by their respective providers and may be subject to separate terms, privacy policies, and service availability requirements.

We are not responsible for the availability, functionality, or actions of third-party services, except to the extent that an issue results from our own failure to perform our obligations under these Terms.

We do not guarantee that every integration will remain available or compatible with future versions of third-party systems.

9. Availability and Maintenance

We work to keep Lecon available, reliable, and responsive.

We may perform scheduled or emergency maintenance, security updates, system upgrades, and infrastructure changes when necessary.

Where reasonably possible, we will provide advance notice of planned maintenance that may affect service availability.

We maintain regular backup procedures designed to support service recovery. However, backups do not guarantee that all data can be recovered in every circumstance.

Unless a separate Service Level Agreement (SLA) has been signed with your institution, Lecon is provided without a guaranteed level of availability, uptime, or response time.

We will make reasonable efforts to investigate and resolve technical issues affecting the service.

10. Fees and Payment

Subscription fees, billing frequency, subscription duration, and renewal arrangements are set out in your order, subscription agreement, or other applicable purchase document.

Where no signed document states otherwise:

  • Subscriptions run for the period paid for.

  • Subscriptions renew only by mutual agreement.

  • Fees are payable in the currency stated in the applicable order or invoice.

  • Applicable taxes are additional unless expressly stated otherwise.

  • Payments are due according to the payment terms stated in the invoice or purchase agreement.

Unless otherwise agreed in writing or required by applicable law, subscription fees are non-refundable once the subscription period has commenced.

If payment is overdue, we may provide written notice requesting payment. If the outstanding amount remains unpaid after a reasonable period, we may suspend access to the service until payment is received.

We will make reasonable efforts to notify your institution before suspending access for non-payment.

Any changes to subscription pricing will be communicated in advance and will generally apply to future subscription or renewal periods, rather than periods already paid for, unless otherwise agreed.

11. Confidentiality

Each party may receive confidential information from the other in connection with the use or operation of Lecon.

Confidential information includes non-public institutional information, business information, technical information, financial information, personal information, and other information that a reasonable person would understand to be confidential.

Each party agrees to:

  • Protect the other party's confidential information using reasonable care.

  • Use confidential information only for purposes related to the agreement and the provision or use of Lecon.

  • Disclose confidential information only to employees, contractors, professional advisers, and service providers who need to know it and are subject to appropriate confidentiality obligations.

  • Not disclose confidential information to other parties without prior authorization, except where required by law.

Confidentiality obligations do not apply to information that:

  • Is publicly available through no breach of these Terms.

  • Was lawfully known to the receiving party before disclosure.

  • Is independently developed without using the other party's confidential information.

  • Is lawfully received from a third party without confidentiality restrictions.

  • Must be disclosed under applicable law or a valid legal order.

Where legally permitted, the receiving party will provide reasonable advance notice of any legally required disclosure.

These confidentiality obligations continue after the subscription or agreement ends.

12. Institutional Responsibilities

Lecon provides tools to help educational institutions organize, manage, document, review, and report curriculum information.

Your institution remains solely responsible for its academic and institutional decisions, including:

  • The design and development of academic programs and courses.

  • The accuracy and completeness of curriculum records.

  • Academic approvals and governance decisions.

  • The quality and suitability of learning outcomes and assessments.

  • The accuracy of accreditation and regulatory documentation.

  • Compliance with the requirements of applicable regulators, accrediting bodies, and government authorities.

  • Reviewing and verifying information before publishing or submitting it for official purposes.

Lecon does not provide accreditation, regulatory, academic, or legal approval services.

Any reports, records, workflows, or documentation generated through Lecon are intended to support institutional decision-making and do not guarantee compliance with the requirements of any accrediting body, regulator, or government authority.

Your institution remains responsible for reviewing and verifying all information before relying on it for academic, regulatory, accreditation, or institutional decisions.

13. Liability and Disclaimer

We work to provide a reliable and useful service, but Lecon is provided on an "as available" basis, subject to any commitments expressly set out in a signed agreement or applicable SLA.

To the maximum extent permitted by applicable law, we do not warrant that:

  • Lecon will operate without interruption or error.

  • Every feature will be available at all times.

  • The service will meet every institution's specific requirements.

  • All information entered or generated by users will be accurate or complete.

  • Third-party integrations will always remain available or compatible.

Nothing in these Terms excludes or limits any warranty, right, or liability that cannot legally be excluded or limited.

Subject to the foregoing:

a. Exclusion of certain losses

Neither party will be liable to the other for indirect, incidental, special, punitive, or consequential losses, including loss of profits, revenue, business opportunities, or anticipated savings, arising from or relating to the use of Lecon.

Neither party will be liable for loss or corruption of data, except to the extent that such loss or corruption results from a breach of an obligation that cannot be excluded or limited under these Terms or applicable law.

b. Limitation of liability

To the maximum extent permitted by applicable law, each party's total aggregate liability arising out of or relating to these Terms or the use of Lecon will not exceed the total subscription fees paid or payable by your institution to us during the twelve months immediately preceding the event giving rise to the claim.

c. Exceptions

Nothing in these Terms limits liability for:

  • Fraud or fraudulent misrepresentation.

  • Death or personal injury caused by negligence.

  • Intentional misconduct.

  • Any other liability that cannot legally be excluded or limited under applicable law.

The limitations in this section apply regardless of the legal basis of the claim, whether contractual, tortious, or otherwise, to the extent permitted by law.

14. Indemnification

Your institution agrees to defend and indemnify LECON EDUCATION TECHNOLOGY INC., its officers, employees, and representatives against third-party claims, losses, damages, and reasonable legal expenses arising from:

  • Content uploaded or submitted by your institution that infringes a third party's intellectual property rights or other legal rights.

  • Your institution's unlawful use of Lecon.

  • Your institution's material violation of applicable laws or regulations.

  • Your institution's material breach of these Terms.

  • Unauthorized use of the service by your Authorized Users resulting from your institution's failure to appropriately manage access.

This obligation does not apply to the extent that a claim results from our own breach of these Terms, negligence, or misconduct.

We will provide reasonable notice of any claim for which indemnification is sought and allow your institution reasonable control over the defence and settlement of that claim, provided that no settlement may impose an admission of liability or obligation on us without our prior written consent.

15. Ending the Agreement

Either party may end the agreement at the end of its subscription term, in accordance with the notice and termination provisions set out in the applicable order or agreement.

Either party may terminate the agreement earlier if the other party materially breaches these Terms and fails to correct the breach within 30 days after receiving written notice.

We may suspend access to Lecon immediately where reasonably necessary to:

  • Protect the security or integrity of the service.

  • Prevent unauthorized access or unlawful activity.

  • Address a serious security risk.

  • Comply with applicable law or a valid legal requirement.

Where reasonably possible, we will notify your institution and provide an opportunity to address the issue before suspending access.

Data access and deletion following termination

Upon termination or expiry of the subscription, your institution's access to Lecon will end.

We will retain your institution's data for 30 days following termination or expiry to allow you to export your information.

During this period, your institution may request an archive of its records in a commonly used electronic format. We will provide reasonable assistance with the export process, subject to any agreed fees for additional services.

After this period, we will delete or anonymize institutional data from our active systems, except for information that:

  • We are required to retain under applicable law.

  • Must be retained for legitimate accounting, legal, or security purposes.

  • Remains in routine system backups until those backups are deleted in accordance with our regular backup retention schedule.

Any retained information will continue to be protected in accordance with our applicable confidentiality and data protection obligations.

Termination does not affect rights or obligations that arose before the termination date or provisions that are intended to continue after termination, including confidentiality, intellectual property, liability, indemnification, and governing law.

16. Changes to These Terms

We may update these Terms from time to time to reflect changes in our services, business operations, legal requirements, or security practices.

If a change materially affects your institution's rights or obligations, we will provide advance notice to your institution's administrators by email before the change takes effect.

Where a material change adversely affects your institution, and you do not agree to the change, you may contact us before its effective date to discuss the matter.

If we cannot resolve the concern, your institution may choose not to renew its subscription, subject to any existing contractual commitments.

Continued use of Lecon after the effective date of updated Terms constitutes acceptance of the revised Terms, to the extent permitted by applicable law.

The date at the top of this document indicates when the current version took effect.

17. Force Majeure

Neither party will be responsible for delays or failures to perform its obligations caused by circumstances beyond its reasonable control.

These circumstances may include natural disasters, fires, floods, war, terrorism, government actions, widespread internet or telecommunications failures, major power outages, public health emergencies, cyberattacks, or disruptions to essential third-party infrastructure.

The affected party will take reasonable steps to minimize the impact of the event and resume its obligations as soon as reasonably practicable.

If the event continues for an extended period and materially prevents the provision or use of Lecon, either party may discuss appropriate arrangements, including termination where reasonably necessary.

18. Governing Law

These Terms are governed by the laws of British Columbia, Canada, without regard to its conflict of law principles.

The parties agree that the courts of British Columbia, Canada, will have jurisdiction over disputes arising from or relating to these Terms, subject to any mandatory rights or protections that cannot legally be waived or excluded under applicable law.

Nothing in this section limits any rights your institution may have under mandatory consumer, privacy, or other applicable legislation.

19. General Provisions

Entire agreement

These Terms, together with any applicable order, signed agreement, DPA, SLA, and Privacy Policy, form the agreement between the parties concerning the use of Lecon and replace any previous discussions or understandings relating to the same subject matter.

Assignment

Your institution may not transfer or assign its rights or obligations under these Terms without our prior written consent, except where the transfer occurs as part of a merger, restructuring, or transfer of substantially all of its relevant operations and the successor agrees to assume the applicable obligations.

We may assign or transfer our rights and obligations as part of a merger, restructuring, corporate reorganization, or sale of substantially all of our business or assets, provided that the assignee assumes the applicable obligations under these Terms.

Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in effect.

No waiver

A party's failure to enforce any provision of these Terms does not constitute a waiver of its right to enforce that provision later.

Independent parties

Nothing in these Terms creates a partnership, joint venture, employment relationship, or agency relationship between the parties.

Notices

Contractual notices must be sent to the contact email addresses designated by the parties for official communications. Notices to Lecon may be sent to info@lecon.app.
